Terms of service

These terms govern the use of the Branch Pilot website, application and API (“the Service”) provided by INNOFI SASU, 07210 Chomérac, France, RCS Aubenas 510 177 199 (“INNOFI”, “we”). By creating an account you accept them on behalf of the business you represent (“you”, “the Customer”). The Service is intended for professionals; consumers benefit from the mandatory provisions of the French Consumer Code in addition.

1. The Service

Branch Pilot is a decision layer for automation workflows: you define decisions (route, score, classify) without code, test them, and call them through an API from Make, n8n or your own systems. Answers are produced by third-party inference engines (TypeSafe AI’s Jev, with Mistral AI as a fallback) on pseudonymized payloads. Probabilistic by nature, an answer may be wrong; you remain responsible for how your workflows act on it, and for keeping a human in the loop where the consequences require it.

2. Account and API keys

You must provide accurate information and keep your sign-in method and API keys confidential. Keys are shown once at creation; revoke any key you suspect is compromised. Everything done with your keys is deemed done by you. One person per account in this version; contact us for team access.

3. Acceptable use

You agree not to use the Service to make decisions that are unlawful, that discriminate against people on protected grounds, or that produce legal or similarly significant effects on individuals without the safeguards required by applicable law (including Article 22 of the GDPR and the EU AI Act where they apply). You agree not to send special categories of personal data (health, biometrics, beliefs, etc.) unless you have declared the relevant fields as personal data and hold a lawful basis. You will not probe, overload or reverse-engineer the Service.

4. Plans, quotas and billing

  • The Free plan includes a monthly quota of decisions and no card; we may change its limits with 30 days’ notice.
  • Paid plans are subscriptions billed monthly or annually in advance through Stripe, in euros, excluding VAT. Annual plans are discounted and non-refundable except as required by law.
  • Each plan includes a monthly quota of decisions. When it is reached, calls return HTTP 429 until the next period; there is no overage billing. You can upgrade at any time; the change takes effect immediately and is prorated.
  • Prices may change with 30 days’ notice; the change applies at your next renewal.
  • VAT is applied according to your country and VAT number. Invoices are issued by INNOFI and available in the Stripe customer portal.

5. Availability and support

We aim for high availability but the Service is provided without a guaranteed service level outside an Enterprise agreement. We may perform maintenance and may suspend the Service in case of security risk or abuse, with notice where possible. Support is provided by email; response targets depend on the plan.

6. Your data

You own the decisions you define and the data you send. You grant us the right to process them solely to provide the Service. For payload data you are the controller and we act as your processor under our data processing agreement (available on request), which incorporates the pseudonymization described in the privacy policy and the list of sub-processors. We keep run history for 7 days (Free) or 30 days (paid plans), then delete it. On termination we delete your data within 30 days, except what the law requires us to keep.

7. Intellectual property

The Service, its software, templates and documentation remain the property of INNOFI and its licensors. You receive a non-exclusive, non-transferable right to use them for the duration of your subscription. You may not resell the Service as such; building products and workflows that call it is of course permitted.

8. Liability

The Service is provided “as is” within the limits above. To the extent permitted by law, INNOFI is not liable for indirect damages (loss of profit, business, data or reputation) or for the consequences of decisions taken on the basis of an answer. INNOFI’s total liability for any 12-month period is limited to the amounts you paid for the Service during that period. Nothing excludes liability that cannot be excluded by law.

9. Term and termination

Subscriptions renew automatically until cancelled from the customer portal; cancellation takes effect at the end of the current period. Either party may terminate for material breach not remedied within 15 days of notice. We may close inactive Free accounts after 12 months of inactivity, with notice.

10. Changes to these terms

We may update these terms; material changes are announced by email at least 30 days in advance. Continued use after that date constitutes acceptance.

11. Law and jurisdiction

These terms are governed by French law. Any dispute that cannot be settled amicably is submitted to the courts of the registered office of INNOFI, subject to mandatory rules applicable to consumers.
